1. Acceptance of Terms
By accessing and using Tracemate (the "Service"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this Service.
We reserve the right to update or modify these terms at any time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, by email. Your continued use of the Service following any changes constitutes your acceptance of the new terms.
Our Privacy Policy explains how we collect, use, and protect your personal data in accordance with GDPR and other applicable data protection laws. By using the Service, you acknowledge that you have read and understood our Privacy Policy.
2. Eligibility
You must be at least 16 years of age to use this Service. If you are under 18 years of age (or the age of majority in your jurisdiction), you represent that you have obtained parental or guardian consent to use this Service.
By using the Service, you represent and warrant that you meet these eligibility requirements and have the legal capacity to enter into these Terms.
3. Description of Service
Tracemate is a platform for tracing objects to create highly customized Gridfinity bins. Our Service allows users to:
- Upload and trace object outlines from photographs
- Generate custom Gridfinity-compatible bin designs
- Configure bin dimensions, features, and cutout parameters
- Export designs in STL format for 3D printing
- Save and manage design projects
The Service generates 3D model files based on your inputs and configurations. The actual 3D printing is performed by you using your own equipment or third-party printing services.
4. Service Availability and Changes
4.1 Service Modifications
We reserve the right to modify, suspend, or discontinue any part of the Service (including features, functionality, or content) at any time, with or without notice. We are not liable to you or any third party for any modification, suspension, or discontinuation of the Service.
4.2 Maintenance and Downtime
The Service may occasionally be unavailable due to scheduled maintenance, updates, or unforeseen technical issues. We provide the Service on a best-effort basis and do not guarantee any specific uptime or availability level.
4.3 No Permanent Storage Guarantee
While we take reasonable measures to protect your data, we do not guarantee permanent storage of your projects, designs, or uploaded content. You are responsible for maintaining your own backups of any important data by exporting your designs regularly.
5. User Accounts
5.1 Registration
To access certain features of the Service, you may be required to create an account. You agree to provide accurate, current, and complete information during the registration process and to update such information to keep it accurate, current, and complete.
5.2 Account Security
You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account at help@tracematehq.com.
6. Subscriptions and Payments
6.1 Merchant of Record
All subscription purchases are processed by Polar.sh, which acts as our Merchant of Record. When you purchase a subscription, you are entering into a purchase agreement with Polar.sh, not directly with Tracemate.
Polar.sh handles all payment processing, billing, tax calculation, and tax remittance on our behalf. This arrangement ensures proper tax compliance globally and enables us to offer our Service in countries worldwide.
6.2 Pricing and Billing
Subscription pricing is displayed on our website and within the Service. Prices may vary by region and are subject to applicable taxes. We reserve the right to modify pricing with reasonable notice.
6.3 EU Right of Withdrawal and Digital Services
If you are a consumer in the European Union, you normally have a 14-day right to withdraw from online purchases. However, by using the Service to upload your first image and begin creating designs, you expressly consent to the immediate performance of the digital service and acknowledge that you thereby waive your right of withdrawal.
This is in accordance with Article 16(m) of the EU Consumer Rights Directive, which permits the exclusion of the right of withdrawal for digital content that is not supplied on a tangible medium when performance has begun with the consumer's prior express consent and acknowledgment of the loss of the right of withdrawal.
6.4 Refund Policy
Refund requests are handled in accordance with Polar.sh's policies.
Important: Failed 3D prints, print quality issues, or designs that do not meet your expectations are not grounds for a refund of your subscription. See Section 9 (3D Printing Disclaimer) for more details.
7. User Content and Generated Designs
7.1 Your Uploaded Content
You retain ownership of any content you upload to the Service, including images and project files ("User Content"). By uploading User Content, you grant us a non-exclusive, worldwide, royalty-free license to use, store, and process your content for the purpose of providing the Service, troubleshooting issues, and improving our offerings.
You represent and warrant that:
- You own or have the necessary rights to your User Content
- Your User Content does not infringe upon the intellectual property rights of any third party
- You have any necessary permissions to photograph and trace the objects in your images
7.2 Generated STL Files and Designs
STL files and designs generated by the Service based on your inputs are licensed to you for personal, non-commercial use. You may:
- Download and print the generated designs for personal use
- Modify the STL files for your own personal projects
- Share printed objects as gifts (not for sale)
7.3 Restrictions on Generated Content
Without a separate commercial license agreement, you may not:
- Sell, resell, or distribute the raw STL files on marketplaces or to third parties
- Use generated designs for commercial purposes or in products intended for sale
- Claim exclusive ownership over designs generated by the Service
- Remove or alter any attribution or notices in the generated files
If you wish to use generated designs commercially, please contact us at help@tracematehq.com to discuss a commercial license agreement.
7.4 License to Tracemate
You grant Tracemate a non-exclusive, royalty-free license to use anonymized or aggregated data from your usage of the Service for the purposes of improving the Service, troubleshooting, and developing new features. With your explicit consent, we may also feature your designs on our website or marketing materials.
8. Acceptable Use
You agree not to use the Service to:
- Violate any applicable laws or regulations
- Infringe upon the intellectual property rights of others
- Upload malicious code or attempt to compromise the Service
- Engage in any activity that disrupts or interferes with the Service
- Attempt to gain unauthorized access to any part of the Service
- Create designs intended for illegal purposes or weapons of any kind
- Use automated systems or bots to access the Service without our express permission
- Reverse engineer, decompile, or attempt to extract the source code of the Service or its underlying algorithms
- Scrape, harvest, or collect data from the Service through automated means
- Circumvent any access controls, paywalls, or authentication mechanisms
- Use the Service's output to train competing AI models or services
- Resell, redistribute, or commercially exploit access to the Service without authorization
9. 3D Printing Disclaimer
9.1 Your Responsibility
You are solely responsible for reviewing, verifying, and testing any STL or 3D model files generated by the Service before printing. This includes but is not limited to:
- Checking the model for errors, manifold issues, or printability problems using slicer software or mesh analysis tools
- Verifying that dimensions, clearances, and tolerances are appropriate for your specific 3D printer and materials
- Ensuring the design is suitable for your intended use case
- Adjusting print settings (layer height, infill, supports, etc.) as needed
- Performing test prints with inexpensive materials before committing to final prints
9.2 No Guarantee of Print Success
We do not and cannot guarantee that any design generated by the Service will print successfully. 3D printing success depends on many factors outside our control, including:
- Your specific 3D printer make, model, and condition
- Filament or resin type, quality, and storage conditions
- Print settings and slicer configuration
- Environmental conditions (temperature, humidity)
- Bed adhesion, leveling, and calibration
- Your experience level with 3D printing
9.3 No Refunds for Failed Prints
Failed 3D prints, print quality issues, wasted material, or designs that do not meet your expectations are not grounds for a refund of your Tracemate subscription. By using the Service, you acknowledge and accept this limitation.
9.4 Fitness for Purpose
We make no representations or warranties regarding the fitness of any generated design for any particular purpose. You are responsible for determining whether a design is suitable for your intended application, including considerations of:
- Structural integrity and load-bearing capacity
- Material compatibility with stored objects
- Safety requirements for your use case
- Compliance with any applicable regulations or standards
10. Limitation of Liability and Disclaimers
10.1 Disclaimer of Warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE. We expressly disclaim all implied warranties, including but not limited to:
- Implied warranties of merchantability
- Fitness for a particular purpose
- Non-infringement
- Accuracy, reliability, or completeness of any designs
We do not guarantee that the Service will be uninterrupted, secure, error-free, or that any defects will be corrected.
10.2 Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL TRACEMATE, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, OR LICENSORS BE LIABLE FOR:
- Any indirect, incidental, special, consequential, or punitive damages
- Loss of profits, revenue, data, or business opportunities
- Costs of materials, time, or resources used in 3D printing attempts
- Damage to 3D printers, equipment, or property
- Personal injury or property damage arising from printed objects
- Any damages arising from your use of or inability to use the Service
Our total cumulative liability for any claims arising from your use of the Service shall not exceed the amount you paid to us (if any) in the twelve (12) months preceding the claim.
10.3 Mandatory Legal Protections
Nothing in these Terms excludes or limits liability where such exclusion or limitation is not permitted by applicable law, including but not limited to liability for:
- Death or personal injury caused by negligence
- Fraud or fraudulent misrepresentation
- Intentional misconduct or gross negligence
- Any liability that cannot be excluded under applicable law
10.4 Indemnification
You agree to indemnify, defend, and hold harmless Tracemate and its affiliates from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from:
- Your use of the Service
- Your violation of these Terms
- Your infringement of any third-party rights
- Any 3D prints you create using designs from the Service
11. Intellectual Property
The Service and its original content (excluding User Content), features, and functionality are owned by Bartels Software Studio OÜ and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.
The Gridfinity system was created by Zack Freedman and is used in accordance with its open-source license (MIT License). We are grateful for his contribution to the 3D printing community.
12. Data Retention and Export
12.1 Data Export
You may export your designs at any time by downloading them as STL files from within the Service. For any other data export requests, please contact us at help@tracematehq.com.
12.2 Data Retention After Cancellation
When you cancel your subscription or close your account, your data (including projects, uploaded images, and generated designs) will be deleted immediately. We recommend exporting any designs you wish to keep before cancelling your account.
We may retain anonymized or aggregated data that cannot be used to identify you for analytics and service improvement purposes.
13. Termination
13.1 Termination by Us
We may terminate or suspend your account and access to the Service if we reasonably believe that you have:
- Violated these Terms
- Engaged in fraudulent, abusive, or illegal activity
- Acted in a way that is harmful to other users or third parties
- Failed to pay applicable subscription fees
Where possible and permitted by law, we will provide reasonable notice before termination. In cases of serious violations or fraud, we may terminate immediately without notice.
13.2 Appeal Process
If you believe your account was terminated in error, you may contact us at help@tracematehq.com to request a review. We will respond within a reasonable timeframe.
13.3 Effect of Termination
Upon termination, your right to use the Service will immediately cease. You should export any designs you wish to keep before your account is terminated. We are not obligated to retain your data after termination.
14. Governing Law and Dispute Resolution
These Terms shall be governed by and construed in accordance with the laws of the Republic of Estonia, without regard to its conflict of law provisions.
Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unsuccessful, disputes shall be submitted to the exclusive jurisdiction of the courts of Estonia.
Consumer Protection: If you are a consumer in the European Union, nothing in these Terms limits your rights under mandatory consumer protection laws of your country of residence.
15. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.
16. Security and Abuse Reporting
16.1 Vulnerability Disclosure
If you discover a security vulnerability in our Service, we encourage responsible disclosure. Please report security issues to help@tracematehq.com with details of the vulnerability. We will acknowledge receipt and work to address valid security concerns promptly.
16.2 Reporting Abuse or Rights Violations
If you believe that content on our Service infringes your intellectual property rights or violates applicable laws, please contact us at help@tracematehq.com with:
- A description of the infringing or violating content
- Evidence of your ownership or authorization to act on behalf of the rights holder
- Your contact information
We will review reports and take appropriate action in accordance with applicable laws, including the EU's notice-and-action requirements.
